By booking a photography session or event coverage with Philo Photography, the Client confirms that they have read, understood, and agreed to the following Terms and Conditions.

Booking and Payment

Retainer and Confirmation

A non-refundable retainer of 50% is required to secure any booking. No session or event date is reserved until the retainer has been received and the agreement has been signed. The retainer secures the date exclusively for the Client, covers administrative preparation and communication time, and compensates for other bookings that may have been declined for that date. The retainer is non-refundable and non-transferable unless written approval is provided by Philo Photography.

Final Payment

The remaining balance must be paid no later than the day of the session for portrait bookings and no later than three days before the event for event coverage. No images will be delivered until full payment has been received and cleared. Accepted payment methods include bank transfer, cash, and Juice by MCB.


Pricing

Prices are subject to change at any time without prior notice. Once a booking is confirmed, the agreed price will be honoured for that booking. Additional services requested after the initial booking, including additional coverage time, extra locations, additional edits, or add-ons, will be charged separately. Overtime for events is billed per started hour.


Travel and Location

Travel within a radius of 20 km from Curepipe is included in all quoted prices. For locations beyond this radius, a travel fee will apply based on distance, travel time, and associated costs. Additional expenses related to the chosen location, are the responsibility of the Client and must be covered in full. Any changes to the agreed location after booking confirmation may result in revised travel fees. All travel-related arrangements must be confirmed prior to the service date.


Rescheduling and Cancellation

Client Rescheduling

Clients may request to reschedule their session with a minimum of two days’ notice. Rescheduling is subject to availability. One reschedule may be permitted without additional fees. Further rescheduling requests may incur a fee equivalent to ten percent of the package value.

Client Cancellation

The retainer remains non-refundable under all circumstances. If cancellation occurs within seven days of the session or event, ten percent of the remaining balance becomes payable. If cancellation occurs within forty-eight hours, twenty-five percent of the remaining balance becomes payable. These fees compensate for lost booking opportunities.

Photographer Cancellation

If the Photographer must cancel due to serious illness, emergency, or force majeure, the Client will be offered either a reschedule or a substitute photographer at no additional cost where possible. If neither option is possible, a refund of payments made will be issued excluding any non-recoverable third-party expenses. Liability is limited to the total amount paid.


Weather and Force Majeure

Philo Photography is not responsible for delays, rescheduling, or cancellations caused by weather conditions, government restrictions, natural disasters, illness, venue limitations, or other circumstances beyond reasonable control. Outdoor sessions may be rescheduled once due to unsuitable weather conditions without additional charge. If the Client declines the rescheduling option, the retainer remains non-refundable.


Image Delivery and Storage

Delivery Timeline

Portrait session images are delivered within seven to fifteen days. Event images are delivered within two to four weeks. Delivery times may extend during peak seasons. Sneak previews may be provided at the Photographer’s discretion.

File Format

Images are delivered in high-resolution JPEG format via an online gallery or download link. RAW files or unedited files are never provided.

Archiving Policy

Images are stored for ninety days after delivery. After this period, files may be permanently deleted. Recovery of deleted files is not guaranteed and restoration, if available, may incur an additional fee. Clients are responsible for downloading and securely backing up their images.


Creative Control and Artistic Style

Philo Photography retains full creative control over posing, composition, lighting, editing style, and final image selection. Clients book based on the Photographer’s portfolio style and artistic approach. Editing requests that fall outside the Photographer’s established style may not be accommodated. Excessive retouching or additional editing requests may incur additional fees.


Model Release and Image Usage

Marketing Use

Unless declined in writing before the session, the Client grants permission for photographs to be used for portfolio display, website publication, social media, advertising, printed marketing materials, and competitions. Personal names will not be published without consent.

Opt-Out

Clients who wish to opt out of marketing usage must notify the Photographer in writing before the session or event takes place. Requests made after images have been delivered cannot be applied retroactively.


Copyright and Client Usage Rights

All images remain the intellectual property of Philo Photography. The Client receives a personal-use license allowing the images to be printed and shared digitally for personal purposes. The Client may not sell the images, apply filters or alter the images, submit the images to vendors or publications without written approval, or use the images for commercial purposes without a licensing agreement. Commercial use requires a separate written agreement and licensing fee.


Liability Limitations

Philo Photography is not liable for missed moments caused by lateness, guest interference, venue restrictions, obstructed views, equipment malfunction beyond reasonable control, or actions of third-party vendors. In the unlikely event of total image loss, liability is limited to the total amount paid by the Client. No additional damages may be claimed.


Client Responsibilities

The Client agrees to arrive on time, secure any required location permits, ensure cooperation of participants, supervise minors at all times, and take reasonable care to protect the Photographer’s equipment. Damage caused by the Client or their guests through negligence may be charged accordingly.


No-Show Policy

If the Client fails to arrive within thirty minutes of the scheduled start time without notice, the session will be cancelled and all payments will be forfeited. Late arrivals reduce the available session time and do not entitle the Client to additional time or compensation.


Satisfaction and Refunds

Photography is an artistic and subjective service. No refunds will be issued once the session or event has taken place. Any concerns regarding delivered images must be raised within five days of delivery. Reasonable re-edits may be considered at the Photographer’s discretion. Artistic preference or personal taste is not considered valid grounds for a refund.


Indemnification

The Client agrees to indemnify and hold harmless Philo Photography from any claims, damages, or legal actions arising from the photography session or event, including injury, property damage, or misuse of images.


Agreement

By paying the retainer, the Client confirms full acceptance of these Terms and Conditions. Any questions or clarifications must be raised prior to booking.
